Mon Soutien Services : Terms of Use (Canada)
Effective Date: September 12, 2025
By purchasing or using our support services, you ("Customer" or "User") acknowledge and agree to the following Terms of Usage. These terms are legally binding in all Canadian jurisdictions.
If you do not agree with these terms, please do not use or purchase the service.
1. Third-Party Content & Service Responsibility
- All content accessed via our service is provided exclusively by third-party providers.
- Our company is not responsible for the content, its legality, accuracy, or availability.
- We do not host, manage, stream, or control any media, channels, or broadcast signals.
- The Customer assumes full responsibility for complying with Canadian copyright and content laws.
2. Limitation of Liability
- The service is provided strictly “as is” and “as available”, with no warranties, expressed or implied.
- Our company is not liable for:
- Content unavailability
- Service interruptions
- Streaming quality issues
- Device compatibility
- All liability rests with the third-party service provider.
3. No Sale of Programmed Devices
- We do not sell or distribute pre-programmed, modified, or customized devices.
- Any devices used with the service are the sole responsibility of the user and must comply with applicable laws.
4. No Refund Policy
- All sales are final.
- No refunds or partial credits will be issued for any reason, including:
- Technical issues
- Service dissatisfaction
- Channel changes or removals
- Content unavailability
- Early termination by the Customer
5. Billing & Payment Terms
- All services must be paid 30 days in advance.
- Automatic payments are processed via the payment method on file.
- In the event of a failed automatic payment, a $2.99 CAD administrative fee will be charged to the account.
- If the Customer has two (2) failed pre-authorized payments within any rolling 12-month calendar period, the option for pre-authorized payments will be permanently disabled, and manual payment will be required going forward.
6. User Responsibility
- The Customer is solely responsible for:
- Ensuring internet connectivity
- Providing compatible devices
- Complying with Canadian content laws
- Our company does not assist with content access, channel selection, or legal guidance.
- Ownership and Use of Implayer and TiviMate Applications:
- By using the Implayer or Tivimate applications (the "Applications"), the Customer acknowledges that all licenses, intellectual property rights, and proprietary rights relating to the Applications are the exclusive property of Mon Soutien.
- The Customer is granted a non-exclusive, non-transferable license to use the Applications solely for personal purposes and in accordance with the terms of service.
- In the event of cancellation or discontinuation of the subscription or service related to the Applications by the Customer, access to them will be immediately revoked. The Customer will no longer be able to use, access, or receive updates to the Applications.
- In the event of cancellation of the service, the Customer is required to immediately cease all use of the Applications and delete all copies from their devices. The Company reserves the right to terminate access to the Applications without refund in the event of cancellation or violation of the terms.
7. Support Scope
- Support is limited to:
- Basic account-related inquiries
- Technical assistance for general access or connectivity
- We do not provide support for:
- Content complaints
- Legal questions
- Device setup unrelated to our service
8. Termination of Service
- We reserve the right to suspend or terminate service access at any time, with or without notice, for:
- Violation of these Terms
- Suspected illegal activity
- Abuse of support channels or payment systems
9. Indemnification
- By using the service, the Customer agrees to indemnify and hold harmless our company, its employees, and partners from any liability, claim, or legal action arising from:
- Use of the service
- Violation of Canadian copyright laws
- Misuse of third-party content
10. Modifications to Terms
- These Terms of Usage are subject to change at any time.
- Continued use of the service after changes are published constitutes acceptance of the new terms.
